Palmyra Coaches/Teachers Fired

Have you taken a look at the test to get certified? A good portion of teachers that have been at it for years would have trouble getting certified now.
Nope, but I am a moron, and I am a whole lot smarter than some of these people getting jobs now.

Yeah, that's going to take a search warrant, which would mean that there be probable cause to suspect that a crime has been committed, and that there is specific evidence of that crime within the phone records. It's going to take a little more than "mommy and daddy got mad at the coach so demanded to see his phone records."
I am surprised they even got the actual texts? Most people delete their text and unless you go to the carrier you are not getting those.
Second thing I am curious about is if any of those in the group text were using a private device? If they were they have a right to privacy and then would have to consent to the release of thier texts... and well that might not be good for the school to have not blanked those out.

If the school district owns the phones they can give consent to law enforcement to search the phones. If your employer provides you with a phone there is usually no expectation of privacy. Most employers have you sign that away when you are issued the telephone

CORRECT regardless of what they tell you. When you are using the iPhone you are repping said Company. Very sad but intersting story here as yours truly never has worked in academia so am learning post by post.

I am not sure about that, this is from Boston about a state case, but I would think it would probably be most states.

Not sure if this was an unreasonable search but yeah Missouri in 2014 was the first state to pass a privacy law.

Missouri became the first state in the nation Tuesday to offer explicit constitutional protections of electronic communications and data from warrantless search and seizure by law enforcement.

The amendment to the state’s constitution places communications such as emails, text messages, and cloud storage under the same Fourth Amendment protection from unreasonable searches and seizures as “persons, homes, papers and effect” and will require police to have a warrant to gain access to phones, laptops, and electronic communications. It passed with 75% support in a statewide ballot effort.

That Fing pimple has committed way more felonies than the Orange Man.

How many for Biden vs Trump? Is this a pot meet kettle situation?

But that is for information on each individual's device. Once I send a text to someone else I don't have a right to privacy of my messages on other people's devices. Once that happens if it is sent to a device that is a governmental device it would fall under the Sunshine law, just like any email sent on my school email account from my device. Anything sent through my school email could be requested with FOIA.

That's the crap part of it. The conversations aren't pretty when consumed by the public...but sheesh, people need and should have an outlet to vent. It wasn't public (yes, I get the school issued phone making it "legally" public) conversation. If not for some pissed off parents with an axe to grind, these four guys would still have a job. That's just ugly to me. I get it's the letter of the law, but it makes me want to have those parents entire lives shown under a microscope for all to see.
100% how I feel.

I would imagine many of us agree with you guys on that venting and such. But the reality is that in the culture we currently live you better real careful who you are talking to and in what forum.

I am curious how someone knew enough about what the text conversations among those 4 contained that they pursued the matter?
From what I have heard, 1 of the 4 involved accidentally sent a text meant for their group to a parent group several months ago, and here we are today.

Also, I am pretty sure only 1 of the 4 had a school issued phone. The other 3 were private devices.

Not necessarily, and this is what I do for a living...I love how people shout Sunshine law but it doesn't apply to all things especially when private devices are involved.

No expectation of privacy when using a public device. School issues phones for school purposes. No 4th Amendment right.

If these guys had confined their "venting" conversations to verbal when they were together in private we likely would never had heard about it. Most of us here knows how much it goes on. But doing so by text, where it's recorded on several devices, is just opening yourself up to it becoming public and all the scrutiny that comes with that. If anything it shows a huge lack of awareness and common sense. You simply have to be smarter than that or you will pay the price.

I agree with all of this...yet, still don't think it's really termination level stuff. That's the part that just irks me about it all. Now, if they sucked at coaching football...that's a completely different animal. But that's not what this is about, or at least not on the surface anyway.

Just how long do they retain those old emails??? Asking for a friend. Bahahahahaha

That culture part is what makes me sad...and we've got nobody to blame but ourselves.

The culture that makes me sad is in a national election, the choice is between a walking mummy with dementia and a guy that doesn't know how to not use Twitter.

That's what I said when this all started. Dont put ANY of that in writing!! Alleged shady business 101!!

I can see your point. But everyone there now knows how they talk about people. And this wasn't just simple complaining about normal stuff. They used some pretty derogatory phrases to describe people. It won't be hard to determine exactly who they were talking about either. It wouldn't be a good situation for anyone if they stay. Trust has been broken. They'd always be looked at as "those guys". I don't see how they could be effective teachers, coaches and co-workers. I can see how admin could say they don't want this negative situation to continue and possibly get worse. I'd probably think it was best for them to go too if I had anything to do with it. If for nothing else than for just being so dumb to put it all in writing.

Also looked like a few remarks about the superintendent. If some of the parents they were talking about were also board members, then it would make it even harder to stay. They may not let them go for this, but they are definitely going to be under a lot more scrutiny which would make it hard to do their job.

Agree, in the teaching profession once you get a black eye in a widely publicized incident, you will never recover and it's time to move on.

Man how times have changed...in the late 70's and early 80's what they were saying would have been said openly on the football practice field. Back in the day of QB clubs when you would get to watch film with the head coach, I will never forget this parent was complaining about his kid not starting. Well coach got ahold of it and during one of those meetings the Head coach pointed out every mistake that kid made during the game just kept rewinding that film to watch it again to make sure he was not wrong, and kept asking his dad what he thought of that. That parent never complained again about playing time...Coach had made his point. But today that would not fly.

All really good points. In the end, probably the best path once everything was out.

The stuff that you can see from the chat, while not good, is not why they are in trouble. The stuff you can't see is even worse, and that is the main reasons they are no longer there.

Actually, I vehemently disagree with the thought that this wouldn't fly. This is an example of a coach actually doing his job. "Your son isn't playing because of these reasons." That's a coach showing his work. I completely understand when people talk about the social climate we live in, the way kids have changed, etc. But yet Nick Saban has won in multiple different social climates, UConn has now won 3 mens basketball national titles with different coaches in the last 15 years. They win because their culture is commited to success, not necessarily because they toed the right lines in the culture wars.

Leaders fairly and equitably holding their teams accountable will never go out of style. Society will never change that. These goobers weren't holding anyone accountable.

Here, here!!! Case in point, look at what Coach Nickerson did back in '83. Threw his entire team under the bus after a tough loss. Called the team quitters. When in actuality, it was Coach Nickerson who quit! Coach Nickerson did NOT hold his team fairly nor equitably. I think we all know what happened after that.

Nickerson should have been sent to Class 1A in Mississippi to coach cross country. How in the world did he end up at Minnesota State?

Salem has made a change atop the program. In the aftermath of the Palmyra incident, Coach Kevin Miles has resigned from Salem in all capacities. Salem then moved to promote Coach Neil Myers to Head Coach.
