And it looks like the act gave complete power to the president to declare emergencies except for 6 specific exceptions.

Congress has the power to recend any emergency declaration by passing a resolution in each chamber, if the president vetos it then it must have 2/3 majority to override the veto like any other piece of legislation

We don't know how much drugs is crossing the unguarded border but we do know a lot is and LIKELY far more than is intercepted in ports. They know less than 10 % of them get checked so it's not that big of a gamble. If we get the technology that will check a lot more trucks, like dems have and will vote for, then that risk goes up. I'm sure those guys with "calves like cantaloupes" can carry a lot too.
